No Purchase Necessary: Contest is open to the members of the Facebook community. Participation constitutes entrant’s full and unconditional agreement and acceptance of these Official Rules, which shall be final in all respects.

How to Enter: Submit a photo taken anywhere in the world featuring this Beaver postcard available at any Samesun Backpackers Hostel or can also be downloaded from Samesun.com. Submit entries to the Promotions “tab” located on www.facebook.com/SamesunBackpackers. By submitting your photo, you certify that you own the copyright to the picture and any story included. Any picture can be posted, as long as it’s consistent with Facebook rules and regulations.

Entry period: Contest starts December 7th, 2010 and runs until February 28th, 2010. Any photos received after 12 am PST February 28th 2010 will not be eligible.

Winning: Any picture can win, submitted at any time, and the voting is only a general guideline for the judges and focus groups to consider in their final selection. Winner will be notified via e-mail and Facebook on March 1, 2010. The odds of winning depend on the number of eligible entries received. Samesun officials shall select the winner at its sole discretion. By entering the contest, entrants agree to comply with and be bound by these Official Rules and the decisions of the judges which are final and binding in all respects. Failure to comply with these Official Rules may result in disqualification from the contest.

Prize: The person who submits the winning photo will be awarded, 1 round-trip flight, from any-where, to anywhere in the world up to a maximum of $2,000 Canadian.

Conditions: Prizes are non-transferable. No cash redemption or substitution will be allowed, except at Samesun Backpackers sole discretion. If the prize is unavailable, Samesun Backpackers reserves the right to substitute a prize of equal or greater value. Samesun Backpackers also reserves the right to cancel or modify the Contest or these Official Contest Rules if fraud, technical failures or any other factor beyond Samesun Backpackers reasonable control impairs the integrity of this Contest, as determined by Samesun Backpackers, in its sole discretion. By participating, where allowable by law, entrant grants to Samesun Backpackers the worldwide right to publish, broadcast and use in any media, including the World Wide Web, participant’s entry, name, picture, and likeness, without limitation, for promotional and advertising purposes without additional compensation. Winner or winner’s guardian may be required, in the sole discretion of Samesun Backpackers, to sign and return an affidavit of eligibility and a liability release within ten (14) days of the issuance of such documents or the prize may be forfeited and awarded to an alternate winner.

Eligibility: The Contest is open only to natural persons. In the event of a dispute about the identity of an entrant, each entry will be declared made by the registered account holder of the e-mail address submitted at time of entry. The registered account holder is deemed to be the natural person who is assigned the submitted e-mail address by the relevant Internet service provider, online access provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. With respect to any winning entry, the winner may be required to provide Administrator with proof that the person is the registered account holder of the e-mail address associated with the winning entry.

Liability: By participating in this Contest, you (and if you are a minor, your parents or legal guardians) accept all risk and consequences of entry and participation in this Contest, and agree to release and hold Samesun Backpackers, its officers, directors, affiliates, employees, contractors, subsidiaries, agents and partners harmless from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to this Contest, including but limited to your entry and participation in this Contest, the acceptance and/or use (or misuse) of any prize, printing errors, any claims based upon rights of publicity and invasion of privacy. Entrant shall indemnify Samesun Backpackers, its officers, directors, affiliates, contractors, subsidiaries, agents, employees and partners from and against all claims or suits and any damages or costs (including reasonable attorneys’ fees) arising from or relating to entrant’s violation or inaccuracy of any warrantees or representations made relating to this Contest. Samesun Backpackers assumes no responsibility for errors which may occur in the transmission of entrant’s entry. Samesun Backpackers is not responsible for any fraud or misconduct on the part of the entrants. Should an entrant engage in fraud or misconduct of any nature, including but not limited to a violation of the Official Rules, such entrant shall be subject to immediate disqualification. Samesun Backpackers reserves the right to terminate, modify or amend the Contest at any time if the fairness, integrity, and or proper administration of the Contest is jeopardized. IN NO EVENT SHALL SAMSUN PACKPACKERS BE LIABLE TO ENTRANT FOR ANY LOST PROFITS, OR FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER INDIRECT DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS CONTEST. Entrant’s sole damages shall be limited to entrant’s actual out of pocket expenses, excluding attorneys’ fees. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND CONTEST ENTITIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSES AND/OR NON-INFRINGEMENT.

Law: Contest is void where prohibited or restricted by law. Entrant agrees that all claims relating to this Contest shall be resolved individually, without resort to any form of class action. 10. Entire Agreement. These terms set forth the entire agreement between the parties relating to the subject matter hereof, and supersede all prior agreements and understandings relating thereto, whether oral or written. Facebook is not a sponsor nor an affiliate of this Contest. By entering this contest, you agree to allow Samesun Backpackers to add your email address to our free e-newsletter group. Upon receiving an email from Samesun Backpackers you will have an option to opt-out or to continue to receive our newsletter.
